Haitian Labor Union Law: From Reform to Modernization

The right to organize is of considerable value to employees, as it grants them the freedom to form unions to defend their professional interests and secure decent working conditions.Freedom of association is a constitutional right in Haiti and is reinforced by several International Labor Organization conventions ratified by Haiti. However, Haitian labor law has so far failed to align with the various international agreements that have been ratified. The legal gaps identified in Haitian labor law pose a major obstacle to the development of this area of law. Thus, it is time to consider modernizing it. Therefore, the legal framework must be expanded to cover all aspects of labor union law in order to provide labor unions in Haiti with the effective means to fulfill their missions properly.Furthermore, the significant advances in labor union law in France and Canada must be taken into account to better regulate freedom of association in Haiti.
