This third edition is necessary for two primary reasons. First, it is long overdue. It has been almost twelve years since the publication of the second edition, and numerous appellate decisions interpreting the Alabama Rules of Evidence have been published since then. The Alabama Rules of Evidence went into effect on January 1, 1996, so it is critical for the practitioner to stay abreast of how the rules are being interpreted. Second, and more importantly, several amendments and new rules went into effect on October 1, 2013, not to mention the "Daubert amendment" to Rule 702, which became effective January 1, 2012. This third edition not only provides the text of these rules and the advisory notes, but it also provides commentary, practice pointers, and cases from other jurisdictions for these new rules. We sincerely hope that judges, lawyers, and students will benefit from this edition, and we hope that it will continue to be a valuable resource for years to come.
