BuyBack Terms of Use

1. Eligible Item Submission

By submitting a book, CD, or DVD (“Eligible Item(s)”) for the BuyBack Program, you acknowledge and affirmatively agree to the following:

1.1. You warrant that any item you submit to the BuyBack Program is not counterfeit and was obtained legally by you;

1.2. You will not send us any items except the Eligible Item approved by ThriftBooks in the Eligible Item Offer (as defined below). You agree that if you send us Excluded Items (as defined below), such as items that are not specifically approved by ThriftBooks in the Eligible Item Offer, items that are not in acceptable condition, or items shipped after the Eligibility Period, we may discard those items without payment or liability to you, and we will not issue any refund or return any item;

1.3. The risk of loss of items submitted as part of the BuyBack Program will remain with the Program Participant until ThriftBooks accepts the Eligible Item after receiving and inspecting it. ThriftBooks is not responsible for any loss or damage incurred during shipping. For delayed or lost Eligible Items, Program Participants must contact the shipping carrier;

1.4. We may send you emails at the email address associated with your BuyBack Request (as defined below), unless you later withdraw your consent to receive emails under the opt-out procedures provided in our Privacy Policy; further, pursuant to our Privacy Policy, we may record, use, and keep any information that you provide to us as part of your participation in the BuyBack Program (including, but not limited to, your name, mailing address, zip code, telephone number, credit, debit or payment account information and email address).

2. Program Enrollment

2.1. Eligibility: You may not accept these BuyBack Program Terms if you are not at least 18 years old. If you are between the ages of 13 and 18, you may only participate in the Program if you are supervised by a parent or legal guardian who accepts these BuyBack Program Terms personally and on your behalf. You may not participate in the Program if you are under the age of 13. To participate in the Program, you must be a ReadingRewards member.

2.2. Qualifying Requests: Requests to sell an item to ThriftBooks (a “BuyBack Request”) must be made through our Website by following the steps on this page or through the ThriftBooks mobile app, to qualify for the Program.

3. BuyBack Program Process

3.1. To submit a BuyBack Request, enter your personal information and the book identifying code, either the ISBN or UPC, from the Eligible Item into the request form and press the submit button to receive a price quote (the “Eligible Item Price”). We reserve the right to refuse to buy any item, and we may respond to your submission of any item by rejecting your offer to sell any or all items submitted for purchase. If your item is an Eligible Item(s), and if the aggregate price for the Eligible Item(s) input into the request form exceeds the minimum buyback amount communicated with the form, your offer is eligible for the Program and is the “Eligible Item Offer”.

3.2. If you agree to move forward with the Eligible Item Offer, we will provide you with a pre-paid shipping label and instructions to ship the Eligible Item(s) to ThriftBooks. If you are located outside of the United States, you may still participate in the Program, but you will be responsible for shipping costs, and ThriftBooks will not provide you with a pre-paid label.

3.3. The Eligible Item Price is valid for seven (7) calendar days from the date you receive the price quote that includes the Eligible Item Price (the “Eligibility Period”). You must ship the Eligible Item(s) to us within the Eligibility Period to qualify for the Program.

3.4. Promptly after our receipt and acceptance of the Eligible Item(s), we will process payment for the Eligible Item Price for the Eligible Item(s) received by us consistent with the Eligible Item Offer and these BuyBack Program Terms. If the item we receive is an Excluded Item as defined below, we will notify you of the Excluded Item and will discard, recycle, or otherwise dispose of the Excluded Item without liability to you. ThriftBooks does not return any items, regardless of the reason for the requested return. If you have any doubts concerning the condition or ISBNs of your Eligible Items, please feel free to contact us or send pictures of your book before shipping.

3.5. Payment of the Eligible Item Price will be made to you via PayPal to the email address associated with your BuyBack Request. ThriftBooks is not responsible for delays, including for delays due to your submission of incorrect payment information provided during order submission, banking delays, or shipping delays. ThriftBooks' purchase of Eligible Item(s) is for resale. ThriftBooks' resale certificate is provided as a link with the Eligible Item Offer.

3.6. Excluded Items will not be accepted as part of the Program and will not be returned to the Program Participant if shipped to ThriftBooks. “Excluded Items” are items that (1) do not match the description of the item described by ThriftBooks in the Eligible Item Offer (including if you send fewer than all of the books in a book set associated with a single ISBN), (2) are shipped after the Eligibility Period deadline, (3) we have reason to believe are counterfeit or stolen, or (4) are not in acceptable condition. Acceptable condition for books means a readable copy, where all pages and the cover are intact, although the dust cover may be missing, and where pages may include considerable notes-in pen or highlighter but the notes do not obscure the text. Acceptable condition for CDs and DVDs means an item with significant wear, but still operational, where the original packaging is included but may show significant wear and have holes or tears (instructions or liner notes may not be included), and where media may show scuffs and scratches, so long as they do not materially affect the operation of the item.

3.7. Eligible Items and Excluded Items will be determined in ThriftBooks' sole good faith discretion, and PROGRAM PARTICIPANT ACCEPTS ALL LIABILITY FOR THE LOSS OF ANY ITEM AS PART OF THE PROGRAM PARTICIPANT'S PARTICIPATION IN THE BUYBACK PROGRAM, REGARDLESS OF THE REASON FOR SUCH LOSS.

4. Amendments, Modifications, and Termination of Program

We reserve the right to modify these BuyBack Program Terms or to discontinue the BuyBack Program at any time, with or without notice to you, including effective upon our posting an updated version of these BuyBack Program Terms on our Website.

5. DISCLAIMER OF WARRANTY; LIMITATION ON LIABILITY.

YOU EXPRESSLY AGREE THAT USE OF THIS SITE AND THE BUYBACK PROGRAM IS AT YOUR SOLE RISK. THRIFTBOOKS DOES NOT WARRANT THAT USE OF THE SITE OR BUYBACK PROGRAM WILL BE UNINTERRUPTED OR ERROR FREE. THE BUYBACK PROGRAM AND SITE ARE MADE ACCESSIBLE ON AN “AS IS” AND “AS AVAILABLE” BASIS. THRIFTBOOKS HEREBY DISCLAIMS ANY AND ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THOSE OF DATA ACCURACY, TITLE, NONINFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. THRIFTBOOKS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR PARTICIPATION IN THE BUYBACK PROGRAM, THE SITE CONTENT, YOUR USE OF THE SITE, OR YOUR SALE OF ANY BOOKS TO THRIFTBOOKS. IN NO EVENT WILL THRIFTBOOKS' LIABILITY IN CONNECTION WITH YOUR PARTICIPATION IN THE BUYBACK PROGRAM EXCEED $50.

6. Miscellaneous

6.1. Right to Terminate Program Account: We reserve the right to suspend or terminate your participation in the Program without notice to you, including if we determine in our sole discretion that you have violated this Agreement or that the use of your account may be unauthorized, deceptive, fraudulent, or otherwise unlawful.

6.2. Conflict with Terms of Use: In the event of any conflict between this Agreement and the Thrift Books Terms of Use, the Thrift Books Terms of Use control.
