"UNDERSTANDING DOMESTIC VIOLENCE BY A LAYMAN" is an e-book meant for a layman to have a better understanding of the Act related to domestic violence which is "The Protection of Women from Domestic Violence Act - 2005". Being an advocate, I have encountered people often complaining that they are unable to understand the procedure to apply under sections 12 or 26 of the Act due to a lack of information, knowledge and guidance. When I created my YouTube channel "The Law of Layman" these complaints started to increase gradually. While reading questions in the comment section, I was hit by this idea of summarizing the procedure step by step so that even an ordinary man of prudence would be able to understand the procedure, the status of his case and the line of action he needs to take up. Rapid growth in the incidents of crime against women especially the marital abuse and the acts of violence within the four walls of the house was an unseen challenge before society and was the need of the hour to address before it could become unstoppable. There were two edge challenges before the legislators. One was to put a check on augmenting incidents of domestic violence by providing a security wall to women and, the other was to eliminate gender inequality. Thus, the legislatures under the garb of UN law legislated an Act known as "The Protection of Women from Domestic Violence Act 2005". The Act intends to protect women from being victims of domestic violence and to prevent the occurrence of domestic violence in society. "Aggrieved Person" is the term which has been used to indicate a woman who has been subjected to acts of domestic violence. Other than wife or female live-in partners, female members, sisters, widows and mothers living in a domestic relationship with the abuser are also entitled to get legal protection under the Act. The Act seeks to provide comprehensive guidelines and definition of domestic violence with the emphasis placed not merely on physical abuse but also taking note of the multiple ways in which violence within the family is manifested and affects the women. It is structured towards providing support to women to deal with how domestic violence affects women at multiple levels. The Act further provides the right to a woman residing in a safe, secure, habitable and place free from violence. The Act ensures that a woman must not be evicted from her matrimonial home, irrespective of her right, title or beneficial interest therein. In this book, I endeavoured to explain the basic concepts of the Act in light of Supreme Court and High Courts judgments, in as simple a language as a layman would be able to understand it. I am confident that the e-book will provide a better understanding of the law related to Domestic Violence and will prove to be useful for all concerned in solving or tackling their problems.
