The social responsibility of transnational companies: towards the communities affected by their effects

In Africa, as in Asia in some less industrialized countries, transnational companies, especially extractive companies, are active but not without negative impacts on the environment and respect for human rights. In fact, with regard to the notions of corporate social responsibility, an attempt at regulation has been reported with two currents, namely the voluntary approach and the restrictive one. Through the work, it appears that it is possible to walk with the conventional regime that intervenes either between companies, or between the State and companies, or between companies and communities. However, the fact that the latter are not often associated in the signing of agreements, they become victims of violations of their rights. Hence the need to combine a voluntary approach with a binding one through the respect of international norms in the matter, involving either judicial or extrajudicial actions or advocacy. And yet, as far as CSR is concerned, it is not necessary to wait for the occurrence of the fault for its application because it implies the obligation to respect and prevent.
