The purpose of this research paper is to determine whether the extraordinary remedy of protection-through a court ruling ordering that the judgment be enforced in nature, with full respect for nature's existence and its right to redress- since nature has been recognized as a subject of rights under the Constitution of the Republic of Ecuador, it is important that it be cared for and protected, given that it is the source that provides us with everything necessary for our existence. In this regard, the focus of this study is on identifying the moment when the right to restoration was violated from the perspective of the biocentric theory, which makes this impossible; hence, it is necessary for legal scholars to contribute specialized expertise in environmental matters. The methods to be applied are the deductive method and case study analysis, as the research process begins with the observation of general phenomena, with the aim of identifying specific truths, and similarly applies to a relevant case where cause-and-effect relationships are established within the investigation.
