Does the Fifth Amendment push the right against self- incrimination back from the trial to the moment of arrest? At what stage of interrogation are suspects allowed to consult with a lawyer? Would someone answer these questions differently if their son or daughter were the accused? The Sixth Amendment provides the accused with significant protections. Every defendant is entitled to a speedy and public trial by an impartial jury and to the knowledge of the nature and cause of the accusation against him, to confront the witnesses against him and to have compulsory process for obtaining witnesses in his behalf and to have the Assistance of Counsel in his defense. Can a criminal defendant receive a fair trial without a zealous advocate for his defense to answer the government prosecutor? The Constitutional rights of the accused are all that stands between democracies, our way of life, and a police state. In our way of life, the government's interest is the people's interest. In recent years the government has become a separate and distinct entity, unanswerable to anyone, repelling oversight and disdaining transparency. Those who have the strength of character to stand tall for what they believe, if opposed to the government's views, are aggressively labeled as unpatriotic and subversive. It wasn't long ago that the youth of this great nation struggled under that same type of government oppression and suppression in their rejection of the Vietnam war and the senseless deaths of more than 52,000 beautiful, young American lives.We, as citizens of this great nation, are the sons and daughters of our Founding Fathers and have inherited the fundamental values and principles that they fought for in defining the vision of our liberty and the dream of democracy. Each one of us has a say so in how our nation evolves to meet the changes of a modern and dynamic world. Certain processes must change to accommodate advances in technology and communication together with defining ever higher standards of decency.
