The study was based on the violation of the right to higher education by the National System of Equalization and Admission, which became a legal problem for young graduates to access the educational system in public universities in Ecuador. To this end, a review was carried out of documents, laws, codes, statutes and other regulations relevant to the legal sphere from a constitutional approach to public policy, equal access to higher education and equal opportunities. The result confirmed the violation of the right to access, equality and free higher education in high schools, due to the lack of a quota in public universities at the national level, as well as the lack of coordination of the National Secretariat for Higher Education, Science, Technology and Innovation, mechanisms that do not guarantee the admission process. The right to education is established in international human rights instruments, the Constitution of the Republic of Ecuador and the Higher Education Act in order to guarantee its effectiveness, permanence, mobility and universal access to university places.
