On August 17, 2004, Article 285-A of the Code of Criminal Procedures was incorporated, where the thesis of alternative determination or dissociation of the legal qualification is proposed.The above does not mean, in any way, that the qualification established in the written accusation remains unaltered. The trial court may correct some inaccuracies in the legal qualification, which also includes the title of criminal intervention; however, this power is not absolute and must be formulated in accordance with the rule expressly stipulated in article 374 of the Code of Criminal Procedure.
