The defendant on of their colleagues, was undertaking similar research and used part of their questionnaire in preparing his own questionnaire.The plaintiffs succeed in their claim against the defendant for breach of copyright, and asked for costs on an ideminity basis becasue the defendant had failed to the existence of copyright, until the 40 th day of trial, and never have ownership of copyright, has admitted facts on cross-examination of the trial that he had refused to admit in response to a notice to admit, and had given misleading answers in response.The court found that the defendant's conduct, when it had unreasonably added very considerably to the time and therefore the costs, which had to be spent on case preparation and the trial. Costs on a common fund basis were ordered.
