Family law concerns shares owning authority in the name of plaintiff's deceased sister caseIN an action regarding the status of certain shares. Plaintiff applied to be substituted in place of the two existing plaintiffs in the action. He contended that shares in the name of his deceased sister has been held by his brother in trust for their deceased mother and should therefore form part of the mother's estate. His interest in the matter was that he was a beneficiary under his mother's will. He wanted to replace the two existing plaintiffs, who were the executors of the mother's estate.Those plaintiff executors were unwilling to pursue the claim that the shares should be part of the mother's estate because they were afraid the estate would have to beat the costs of any unsuccessful litigation . They were, however, willing to be replaced as plaintiffs by the decreased mother's son plaintiff and to be joined as defendants. The decreased mother's son plaintiff was substituted as plaintiff for the two executors, who were estate property administered and applied for his benefit, and the executors had refused to continue with the action.
