Any trader, natural or legal person, including all commercial companies in which a State or any other person governed by public law is associated, as well as any economic interest group, whose establishment or head office is located in the territory of the one of the States Parties to the Treaty relating to the harmonization of Business Law in Africa, is subject to the provisions of the revised Uniform Act relating to general commercial law.In addition, any trader or entrepreneur remains subject to laws not contrary to the aforementioned Uniform Act, which are applicable in the State Party where its establishment or head office is located. Thus, each time we sell a commodity or provide a service, the agreement on the thing or service and on the price gives rise to a contract. The seller has the obligation to deliver the product or provide the service and the buyer or beneficiary has the obligation to pay the price. The written document is the means of proof of the commitments made respectively by the seller and the buyer. In the context of business or commerce, this writing which constitutes the means of proof is written on a paper called a commercial document.
