German description: Das Ziel der Studie ist herauszufinden, wann bei bewiesener hypothetischer Einwilligung ein Arzt nicht fur die Verletzung der Aufklarungspflicht haften muss. Zunachst wird die Entwicklungsgeschichte des Instituts der hypothetischen Einwilligung in der Rechtsprechung des hochsten deutschen Zivilgerichts untersucht und insbesondere die Entscheidung des BGH im Jahr 2019 zur Lebendorganspende diskutiert. Von der Achtung des Selbstbestimmungsrechts jedes Patienten ausgehend wird die Auffassung vertreten, dass die tatsachliche Einwilligung, die zwar auf einer normativ unzureichenden Informationsgrundlage getroffen wurde, aber fur den konkreten Patienten hinreichend ist, rechtfertigende Wirkung besitzt. Die hypothetische Einwilligung dient als Nachweis, dass eine solche tatsachliche Einwilligung vorliegt.
