Indeed, this unprecedented use of a trumped up criminal charge designed to remove a CEO and two Managers of what was at that time a highly reputable Financial Institution defies comprehension. It has become crystal clear that none of the allegations made by the DPP and the NBS Board of Directors against the victims are true, as investigations conducted at the NBS (including months prior to the charges), the dismissal of the charges at the Magistrate Court''s level and the findings by the Ombudsman (and subsequently the trials at the High Court, the CoA and the CCJ) have absolved the trio of the false and damning allegations levelled against them by their detractors. Yet after over sixteen years these innocent and dignified men are still in a struggle trying to acquire justice for themselves and their respective families. It must be asked again: Did their Lawyers also deliberately set out to extensively delay the trials and assist in the denial of justice? Were judges compromised? In July 2007, one of Arjoon''s two lawyers, Bernard De Santos S.C. (since deceased) said to Arjoon: " I will not sell you out. I am not the one ". Sadly, it is not only " the one " who betrayed the victims, but many other " ones" . It remains enigmatic, that despite the express statements of questionable conduct by public authorities carried in the Ombudsman''s explosive report, including the rush by the police to lay charges and the role played by the DPP, certain eminent members of the CIOG, a Minister (who attended a meeting prior to the charges being laid) and other persons, no action has been taken by any authority and/or department on that critical report to date. A residual atmosphere prevails in this regard prompting an apprehension that those who once tried in vain to undermine the goodness of the trio are lurking in the shadows and tinkering with the levers of mischief surreptitiously. What about the report by the Bank of Guyana that confirmed the innocence of the trio and why no answer from the Minister of Finance on its suppression? What about the NBS External Auditor who did not inform the members that his investigation also revealed the innocence of the trio, and how did he know that "they" took three days to prepare the trumped-up charges? The NBS members and accountability from the Board of Directors Shockingly the NBS members have been silenced to a point with the hasty amendment to the NBS Act. It remains open to them to demand the truth and accountability from the Board.
