Complete Text

This is a complete and superb text on dispute resolution. It is both introductory and sophisticated. It can be used for an introductory class in ADR in law schools or other university settings. It contains the leading articles and texts of the dispute resolution literature as well as the important documents of mediation and arbitration. Throughout the book are problems and applications. The fifth edition is improved over the last editions but still retains the beneficial attributes of the earlier editions. Because it contains a variety of the leading texts, it would be recommended over the individualized texts from a certain negotiation philosophy. This textbook would not be recommended to a lawyer needing a very quick and how-to guide in preparation for a mediation (see Mediation Representation by Abramson or something similar instead), as the text is comprehensive. Highly recommended.

Leading scholars and practitioners share useful ideas and concepts. The book is laid out well and easily searchable from the TOC or the index. It's easy to read and understand. This book is essential for all helping others to resolve their disputes.

Wonderful book for scholars and practitioners of ADR

A wonderful text book for those working or studying in the field. This book is written for law students and some chapters are drier than others, so beware that it doesn't read as easily as some other ADR texts. Each topic is analyzed from multiple perspectives, accompanied by quotations from experts with distinct backgrounds (attorneys, professors, mediators, professional negotiators, judges depending on the chapter) that explain various points of view. Each chapter is broken down into sub-headings, for example the Mediation chapter includes sections on the process, the role of the public, social science assessments, regulation and enforcement, and professional responsibility. Each of these sections is further elaborated into narrower topics. Peppered throughout the text, you will find thought-provoking questions that probe your own opinion on a particular situation. Slightly dry for the novice interested in mediation as a side-job or hobby, but for those who really want to learn about the legal, ethical and practical issues in all types of ADR with real-life and fictional examples, this book can't be beat. I have found something fascinating and insightful on every single page so far.
