Taking Nazi-looted artwork and "degenerate art" by way of example, Andreas Bergmann traces the complicated nexus of this procedure. German description: Das (besitzlose) Eigentum ist kein ewiges Recht. Es kann sich mannigfach verfluchtigen, fur den ursprunglichen Eigentumer verloren gehen. Wenn es nicht schon vorher zum Erwerb eines Dritten vom Nichtberechtigten gekommen ist ( 932 ff. BGB), findet der Verfall als Vorgang in der Zeit statt. Dem nicht besitzenden Eigentumer rinnt sein Eigentum durch die Finger. Die Zeit kann akquisitiv wirken. Der Zerfall geschieht ruckstandslos, wenn ein Dritter durch Ersitzung eigenes Eigentum geriert. Aber auch wo es nicht zur Ersitzung kommt, erodiert das Eigentum. Denn die Zeit wirkt extinktiv. Der Herausgabeanspruch aus dem Eigentum verjahrt. Andreas Bergmann spurt diesen, teils ausserst komplizierten Zusammenhangen am Beispiel von NS-Raubkunst und sogenannter "Entarteter Kunst" nach.
