This thesis is based on the idea of examining the history of data retention and demonstrating why data retention, at both European and national levels, violates fundamental rights on the grounds of proportionality. The main thesis of this thesis is a comprehensive examination of the compatibility of the Data Retention Directive with European fundamental rights. This also applies to the compatibility of the national implementation of the Data Retention Directive with fundamental rights, specifically Article 8 of the ECHR and the fundamental right to data protection under the Data Protection Act 2000.
