The aim of this thesis is to examine the damages and the elements of the offence relating to 'price-shadow' damages under competition law. First and foremost, we will address the question of who has standing to bring a claim and who is liable. We will then analyse in more detail the individual elements of the offence relevant to 'price-shadow' damages. The thesis is divided into two main chapters: The first chapter discusses the significance and function of private enforcement of competition law in general, in order to provide an understanding of why the recovery of damages arising from price-shading also contributes to strengthening the fight against anti-competitive practices. In the second chapter, the main body of the paper, we examine the significance of damages arising from price-shading, standing to bring and to defend a claim, and the criteria for attribution in cases of price-shading damages.
