Araguaia Guerrilla vs. Brazil

The aim of this work is to assess the Brazilian state's compliance with the judgement of the Inter-American Court of Human Rights in the case of Gomes Lund et al. It found that the Inter-American System for the Promotion and Protection of Human Rights was inaugurated in 1948 with the American Declaration of the Rights and Duties of Man and became an important mechanism for realising human rights on the continent in 1979, with the establishment of the Inter-American Court of Human Rights. In 2010, the Court found that Brazil had violated human rights recognised in the Pact of San Jos de Costa Rica. These violations occurred when the Brazilian state used excessive force to carry out a series of military activities aimed at eliminating an armed resistance movement to the government regime, which was being organised on the banks of the Araguaia River. It was noted that the sentence condemning the Brazilian state listed 12 reparation measures and that, despite the state's efforts, only four of these measures were fully complied with. Thus, it was concluded that the Brazilian state had partially complied with the sentence.
