Application of the Monitorio Procedure in South America

As a result of the publication of the General Organic Code of Processes, several types of procedures applicable within the procedural law were created, among them we find the new order for payment procedure. Figure that during the last five years has been widely developed in Ecuador, for being a mechanism that facilitates the collection of a debt acquired through an executive title, this mechanism helps to resolve a conflict in a short period of time.The purpose of this research is to know the development and impact that the payment order procedure has had in our legal system. In its beginnings, the order for payment procedure arises from the Roman and Germanic procedural law, spreading to several European countries such as Italy, France, Spain, among other Latin American countries, promoting its use. This new procedure adopted by our legislation in the General Organic Code of Processes is considered an effective and efficient tool used by several legal professionals.
