The aim is to evidence a social tension that exists in Colombia regarding the level of deference we should have with the rest of the animal species, a tension that permeates the scenarios of legal battle for their protection and rights, resulting in both legislative and jurisprudential ambivalence. A political-moral and empirical study will be made on the legal regulation of the matter, with a brief reference to comparative and public international law, reviewing the landmark judgments and finally analyzing the theoretical feasibility of positivizing rights to some species of non-human animals in the Colombian cultural context.
