This casebook provides an introduction to the legal relationships between American Indian tribes, the federal government, individual states, and others. The foundational cases are incorporated with statutory text, background material, hypothetical questions, and discussion problems to structure the classroom experience and enhance student engagement. Historical materials are explained to highlight their modern relevance. The third edition includes expanded materials on law and order within Indian country, the Indian Child Welfare Act, and recent Executive Branch actions that increase tribal authority.
American Indian Law, Cases and Commentary (American Casebook Series) This is the first completeley new book in the federal Indian law arena in years. It is well-organized and unlike the other books in the field, it takes into account the dramatic changes in U.S. Supreme Court jurisprudence regarding tribal jurisdiction over the last 20 years. The notes and comments are critical of the Court, but the authors are careful to present both sides of the issues to encourage critical thinking. While designed for basic and advanced law school courses, it could also be used by undergraduates and is a nice resource to have on the shelf as a reference. I am an Indian law practitioner with over 20 year of experience and I teach Indian law from time-to-time. It is nice to see new and old cases presented to be able to see what the authors (who are all leading scholars in the field) think about the state of the law.
